Legal Question in Real Estate Law in Michigan
My husband was forced into retirement after his place of employment closed. He has a secure income and I have a pretty secure job. Our income has been cut in half since then and we have made all the cut backs we can. We have been trying for a year to modify our home loan with no sucess as of yet. We have talked about short selling, but just don't want to give up our home. Can we sue our mortgage company to sell it to us for what they would sell it to someone else for (its current value)

No. You owe what you owe and you keep paying, short sell or let it go into foreclosure. It is a tough situation, but there is no cause of action against your mortgage company. www.kliszlaw.com Tim Klisz
