land use dispute

My property is adjacent to a Company. The original owner signed an agreement with the Company about 30 years ago to allow the Company to direct the rain/sewer water to the backyard of my property. Every time after the pure rain, my backyard becomes a pond. I tried to talk to the Company for resolution, but the Company refuses to take any actions because of the agreement signed by the original owner about 30 years ago. I really need legal advice to settle this dispute. What kind of lawyer should I be talking to? Thanks.

You need a real estate lawyer, which is what I am. It sounds like the company has an easement for runoff. This may be difficult to defeat, as the covenant granting the easement runs with the land. You could argue that the runoff is a nuisance, but that argument is tenuous given the easement. For more info, please contact my office at (248)851-3171.
