Legal Question in Real Estate Law in Michigan
Our Michigan short sale was scheduled to close on 12/20, but it was discovered during closing that the approval of our second lender was missing. The REA, represented us and the buyers and assured us that the deal would be finalized the next day and that he would deliver paperwork. It ended up being more complicated than he realized. On 12/28 we discovered that the buyers had moved into our house two days prior. When we confronted the agent he admitted that he gave the buyers the keys at the closing on 12/20, also admitting that he shouldn't have done so. The agent now wants us to sign a lease agreement and obtain insurance for the next month while he continues to work at closing the deal. We are not comfortable with this at all and are not sure what our options are at this point?

Get a lawyer on board ASAP and start communicating with the realtor and their attorney. A lawsuit would ensue if it couldn't be negotiated quickly. Be very wary at this point.
