Legal Question in Real Estate Law in Michigan

money

paid off my brothers trailer to help him out of a situation. That was over 2 years ago and his financial situation has changed for the better. I would like my money back but he has decided not to give it to me. I only have my bank statement plus a copy of the check I wrote to pay off his trailer. Do I have a legal leg to stand on?

Re: money

Was the payoff understood to be a loan? If so, the you may have a lawsuit for breach of contract to repay the loan.

Consider having an attorney write a letter to him.

Re: money

You could sue him for breach of contract, but you'd have to prove that the money was a loan, and not a gift, and without any agreement or writing, the judge would have to determine who was telling the truth or what the parties' original intentions were.
