I was a mortgage originator within the past six months. I had a customer in which I had many troubles getting approved for a refinance because they couldnt make the large payment. I did some research on companies around the country that charge ridiculous fees for people who are credit challenged as was this case. I had told this customer that there was going to be additional charges of $6000.00 for our in house attorney fees and additional charges for me that had to be paid to me directly after I got the loan done. I did not use the in house attorney but I spent countless hours avoiding thier house going into bankruptcy. I finally got there house refinanced and they paid me willingly the $6000.00. Now they have filed a complaint with our police dept. against me for fraud. Can you tell me if this will turn into a civil complaint which I would pay them back or do you think this will turn into a criminal complaint? I know they had a detective talk to them but family told the police det. that the money was given to me willingly. Also, I did get paid the $2300 from my mortgage company for completing the loan which had nothing to do with the $6000.00

I believe it was improper for you to charge an additional $6000 for the loan. That is why you get paid a broker fee or commission. I would not be surprised if you were served with a civil law suit.
