Legal Question in Real Estate Law in Michigan

My mother's will

My Mom passed away three weeks ago. Had a will wanted the house sold. Changed her mind and had a new desire signed and notorized. Is that legal?

Re: My mother's will

This presents in interesting question. I am assuming that the second item she signed you dont believe is a will by ordinary standards. If it is a will, your mother was likely free to change her mind as long as she had the ability to do so. If the second one is not a will then her desires in the second document may not be enforceable.

However, depending on what the second document says and looks like a court MAY find that it is a will even if it doesnt meet all the requirements through the process of judicial notice. This is a case where you should consult an attorney to see about what they believe may the best course of action.
