My neighbor put up a fence without a village permit. Her fence is 1and 1/2 foot onto my property. Can I remove the fence?

If her fence is on your property, you can make her remove it.

If her fence is on property that you both thought was your property,

and you both acted like it was your property for more than 15 years,

you may be able to make her remove it.

If the village requires a permit for a fence, the village can make her remove it.

1. You need a staked survey.

2. You need a real estate attorney to apply the law to the facts of your case.

3. Don't remove the fence yourself before doing 1 and 2.
