Legal Question in Real Estate Law in Michigan

If a person is going to buy a piece of real property and a broker or attorney is putting the deal together and fails to inform the buyer that he is over paying for the property and why they feel that way, leaving it up to the buyer to make the final decision as to the amount they are willing to pay, is the broker or attorney guilty of negligence or malpractice?
