personal property with receipts and proof
I am a musician and no longer play with this perticular band anymore, although i have personal property which is in their possession. I had payed cash for equipment i purchased in April of 2003 in the amount of 4398.00 and have all the receipts including my debit card confirmation. There was a personal obligation by 2 other members to pay back 50.00 each for every show we were doing, which averaged 3 weekends per month. I have a recieved only half of the money owed to me when they fired me from the band in November of 2004. They are still using the equipment i purchased in shows as we speak and i want to know what is the best way to collect on this debt. There was no contract signed nor submitted for their repayment to me. what can i do legally?? sincerely broke, michael Claffey

Based on the facts you have provided, there is no easy answer because although you have receipts for personally paying for these items, you state that they have paid half the balance and the items are in the band members' possession. With a balance of approximately $2,000 left, I would suggest that you take this dispute to small claims court where parties represent themselves. The action can be brought in the district court where the agreement was reached.

You could sue them on a non-written agreement to repay the money, if you can prove such an agreement existed. You can also start a lawsuit for what is called "claim and delivery," in order to recover your property. For more info, please contact my office at (248)851-3171.
