Property Deed

How do I remove my child's name,

who is a minor from a deed on an

investment property in Michigan.

We live in Virginia. What forms do I

have to fill out? I was scheduled to

close on a sell of this property on

1/28/08, when the question of his

name being on the deed arose. This

property is not an inheritance. I

purchased it at a tax lien auction. I

was told that I shouldn't have placed

his name on the deed. Desperate!

Unfortunately, you will very likely have to retain a Michigan attorney who is knowledgeable regarding the real property laws and procedures of that state in order to resolve this issue. This attorney will very likely have to file the appropriate papers to get the matter before the appropriate Michigan court which is empowered to rule on this matter and during this process this court would also very likely be required to appoint a special guardian to represent the interests of the minor child in this matter(which you would also probably be expected to pay for.)

However, for a more definitive and reliable answer regarding this issue, you should contact a Michigan attorney. (Since a Virginia court would not have jurisdiction over the Michigan property nor the power to affect the deed as it's now recorded in the land records of the Michigan court where the subject property is located, I do not believe that this particular problem could be resolved by your petitioning any of the courts within the Commonwealth.)
