A property was listed for sale online. The price and the terms were clearly stated in the listing. At the bottom of the listing the agent typed his name. I was ok with price and terms and accepted the offer to sell in writing. The only contingency was for conventional financing, which was acceptable per the listing
Is the signed listing considered an offer to sell? Is the agents typed name considered a signature under the Electronic Signature Act? Is my signed agreement to the price and terms in the listing considered acceptance of the offer to sell?

There needs to be more facts here, but an electronic listing is not an offer which can be accepted without a writing signed by both sides. The Statute of Frauds applies and this would not be enforcable. www.kliszlaw.com Tim Klisz
