Legal Question in Real Estate Law in Michigan

Pursued by Baliff for notice of pending action after six-seven yrs.

1. What is the statue of limintations for a company to file action for service of process regarding a defaulted automobile loan since 2002?

2. Though seperated from a spouse (no through legal process) yet, occupy separate households is there any legal recourse the party can seek on non-involved spouse?

3. If so, what necessary steps can be taken to prevent the non-involved spouse from being negatively impacted? This debt was incurred two yrs. prior to marriage.

The SOL is 6 years from the date of last payment made on the debt. It is the filing of the suit that counts, not the service of process. Assuming the last thing you said is true, the spouse was not on the note, thererfore is not liable and the debtor has no recourse against them. Visit www.kliszlaw.com to discuss. Tim Klisz
