hello my question is how do i get a copy of my deed to my house ? My husband and i bought a house by land contrac in 1985 and we paid it off in 1990 about .the person said he file the deed and we didnt think any thing about it for years .so we tried to get a copy of our deed to the house and it was not on file so how do we get a copy of our deed if we can't find the person we bought it from we think he may have passed away .thankyou

You question highlights the danger of handling land contract matters without an attorney or title company. Under the normal process, a deed is signed by the seller and kept in escrow until payoff. At that time, the deed is released to the buyer who records it themselves so they know they are the owners.

Now, you will need to track down the seller or their family to see if they are still alive to sign a new deed and they are not, you need to probate their Estate to get a deed. It can all be done, but its the very difficult way to go. Contact me if I can help. Tim Klisz
