Legal Question in Real Estate Law in Michigan
Roomate suing me for Security Deposit
I signed a joint lease with a roommate last year. For her own reasons, she decided to leave the state 2 months into the lease without finding a permanent subletter nor paying any remaining rent. I had to find 3 different subletters throughout the year to replace her spot. With one of the subletters, I heavily discounted the price and had my landlord take out the remaining unpaid rent out of the shared security deposit. The original roommate is now suing me for her entire amount of the security deposit, which she claims I used her money to pay for my own rent.
This original roommate is very manipulative, has taped our phone conversations w/o my knowledge, and has gotten her lawyer to draft a fancy letter that absolves her from all payments. As a student, I don't have that luxury, am nervous about going to small claims, and would like some advice on how to handle this. Thanks!

I would like to see the complaint she served you with. You can file a counter-claim for your loss. Please contact me to discuss further.

To Whom It May Concern:
This is in response to your email of September 29, 2001, which this office received on November 6, 2001.
By the time you receive this, you may have already had your hearing at small claims court. However, it appears to me that if everything you say is true, you should prevail.
Frankly, I am surprised that your ex-roommate would come back to Michigan to try to collect a portion of a security deposit unless something else is going on here.
Sincerely,
