Legal Question in Real Estate Law in Michigan

My son had a deal on a foreclosed property in Michigan and 2 days before the closing, the bank who owned the property stopped all closings of foreclosed homes. That was in early October. Now all of a sudden they want to close, and he no longer qualifies for the loan, because being self employed and in commercial construction, he hasn't had much work this winter. Anyway, he had to have a well and septic, fix the well pump, pay to have the well chlorinated and pay for an appraisal, all to get his loan. All of this comes to around $1,600,

plus his $500 earnest deposit. He told them he wants to be reimbursed before he signs the release of the contract. They said they would give him back his deposit and $500. Can he take them to small claims court for unjust enrichment for the rest if they refuse to pay?
