Legal Question in Real Estate Law in Michigan

Tenents in Common

Thanks in advance.

My Father passed away. He had no will. His name is on the title for Real estate along with his 2 brothers and his parents. Both of his parents are also deceased. My dad was married as are the 2 remaining brothers. I am my Dad's only child. Do I have any interest in this real estate? Although my Dad, his brothers, and all their spouses live in Washington State, the Real Estate in question is in Michigan.

Re: Tenents in Common

The answer depends on the language in the deed. If the language represents a joint tenancy with rights of survivorship, then upon death, the property of the decedent goes to the remaining survivors. If the language represents tenants in common, then the property will pass to the descendants of the decedent owner.
