Legal Question in Real Estate Law in Michigan

Are there things that are illegal to remove from a home upon sale? For instance, a medicine cabinet or attached shelving that caused damage to remove.

Any item that attached by nail ,screws, or glue to the property is real property, not personal property.

If removing an item causes damage to the property, it is real property, not personal property.

Any item that is part of the real property that the seller wanted to take, had to be specifically excluded, in writing, in the purchase agreement. You are entitled to the full value of whatever it costs to have that item replaced and installed.

If you used a Realtor to help you in the transaction, that person can confirm that the item was present when you purchased the property. If you bought the property for-sale-by-owner, you will have a harder time proving that it was there, unless you have photos. A real estate attorney can apply the law to your specific facts and tell you exactly how to proceed.
