Legal Question in Real Estate Law in Michigan

Title registration

My mother recently died. She had typed up a new title document adding myself and my siblings to the title of property she owned but the title was not registered before she died. Is the new title legal without being registered or will we need to probate it?

Re: Title registration

A deed is valid when it is executed and delivered. Recording(registering) is not required for validity. For more info, please contact my office at (248)851-3171.

Re: Title registration

A deed is valid even if not recorded so long as she intended delivery and made proper delivery to you and your siblings. If it is properly signed and notarized, you can have it recorded in the county where the property is located.
