Legal Question in Real Estate Law in Michigan

tree cutting on my property

I own 10 acres in northern michigan which is in a property owners association. They try to tell me that I can not sell some of my trees unless I have an improved parcel permant structure or if I own two or mor parcels. I have started a drive and put a new shed on the property. They say still not good enough. Also a friend of mine that lives in the same county talked to county commissioner who said that no association can tell me what I can or can not do with trees on my property. What do you think about this ? Thanks Tom

Re: tree cutting on my property

I'm with the county commissioner on this one Tom. If you would be able to cut down the tress, they have no standing to tell you whether you can sell them. Certainly you would be able to cut down the trees unless there is some provision in your deed or the master plan preventing this. Ask them to provide the authority upon which they are relying for their position.

I do have an article which might be of assistance to you in understanding HOAs at my website, www.lawrefs.com. Search under corporations to find the article. Please follow-up with future questions directly to my email.

Good luck!
