Legal Question in Real Estate Law in Michigan

tree liability

Mobile home park resident: tree in next lot rotted and fell on my home. Broken trunk is setting in neighbors yard but the rest of it is leaning on my trailer, reaching completely over the entire roof. I have no insurance. Who is responsible for tree removal? , me or neighbor or park owners? Neighbor has tried to get park owners to remove the tree for 7 years. I have lived here for only a few months and was not aware the tree was bad.

Re: tree liability

Likely the mobile home park, but you need to review the terms of your lease agreement. Put all correspondence in writing. If your neighbor had placed anything in writing about requesting the tree be removed, that would be helpful to you, to show that the mobile home park had "notice" of the tree's condition and/or that it was a hazard.

Contact the manager of the mobile home park immediately, and again, put all your requests in writing. You may also wish to contact the mobile home park's insurance company if you can't get anywhere with the manager.
