Legal Question in Real Estate Law in Michigan

I want to trim a tree that hangs over my property line.

My neighbor has a cotton wood tree that hangs over my property. I detest this tree, whenever the wind blows fairly hard I have a huge mess of twigs, and branches to clean up. I spoke with her about it getting cut down and she wanted me to pay half. I don't think so.

I would like to rent a man-lift and trim everything that hangs over my property line.

My question is this. This is a very large tree and I am afraid that by cutting what hangs over my line and puts stress on the rest that hangs on hers causing the tree to fall and damage her property would I be liable? Some of the tree that hangs over my line has large branches, maybe 4, 5 or even 6 inches in diameter and I am worried about putting the tree out of balance causing it to fall in a good wind.

If a tree is on or near the boundary and it's branches are encroaching onto the adjacent property, the adjacent property owner has the right to trim the branches, so long as the trimming does not harm/kill the tree. For more info, please contact my office at (248)851-3171.
