Legal Question in Real Estate Law in Michigan
I have vacant property in Michigan that was given to myself,my brother and my sister by our father. Everyone was to split the taxes when they came due. Now no one wants to pay and I have records of when they stopped paying. Can I legally sell it or give the property to my son for the amount that my brother and sister owe?

No. You can hire a real estate attorney to file a claim against your brother and sister to partition the property. If the property cannot be divided and shares apportioned, then the court will order the property to be sold to the highest bidder. You will also be able to deduct their share of the taxes you paid from the amounts due to them. Your son may be the highest bidder, but the sale must take place in an open market.
