Legal Question in Sexual Harassment in Michigan

10 yr. old girl makes statement using the word sex, sexual harassment?

My 10 year old daughter said the following, at recess, to a male fellow student, in response to him calling her fat:

''Oh yea, well your bad cause you said you want to have sex with Mary!''

The male student told on my daughter and the teacher reprimanded my daughter stating she could go to juvenile for sexual harrassment.

Is what my daughter said sexual harassment?

I meet with the principal on Monday so would like to have my facts straight on sexual harassment.

Mary, the girl my daughter referred to, was present and heard the comment.

your daughter has not comitted sexual harrasment, that is only in a employer setting. She may face some school discipline, but has not commuted any crime. Contact my office if you would like to discuss further. Tim Klisz
