Legal Question in Sexual Harassment in Michigan

Hostile Work Environment

With my current employer I have experienced being pinched on my rear while standing on a ladder, somone walking into a bathroom that I was working in, undo his pants saying he had to pee, I said wait until I leave, he said stay there, just don't look. His phone rang and I quickly left the room, he came out behind me, and said now I can't go. I've reported these and other incidents to my supervisor, she makes excuses. I've also had problems with my supervisor, such as driving impaired, yelling at me and causing a seen while in public places etc. I wrote a note to the manager asking to talk to him at his earliest convenience, 5 days later he approached me, he said ''Let me guess this is about the supervisor?'' I told him partly. He said that I wasn't the only one, his supervisor was his right arm man. He didn't want to hear details, he realizes that no one should feel unsafe at work, he doesn't want to shut me down, but if he were to have a talk with her it would make matters worse, that's just the way it is, but if anything else happens let him know.

I am quiting, Do I have to give notice and what reason do I give, to be eligeable for unemployment? Is there anything else that can be done?

Re: Hostile Work Environment

You can get unemployment. More importantly, you would have a claim under the Michigan Elliot-Larsen Civil Rights Act and also, federal laws. Remember, if you are going to utilize the federal laws, you must file a complaint with the Equal employment Opportunity Commission right away. then, after they issue a "right to sue" letter, you must file within 90 days. It is very important to your case to have coroboration. Therefore, other witnesses become extremely important. See if you can round some up. Give me a call if you are interested. William S. Stern

Re: Hostile Work Environment

That sounds like a fairly outrageous work environment. If you are quitting because of the sexual harassment, you should definitely talk with an attorney beforehand. You may have a cause of action and the manner in which you handle the situation could impact your ability to proceed with a lawsuit. I'd be happy to discuss your situation with you if you'd like 248.865.9640.
