Legal Question in Sexual Harassment in Michigan

Recently my husband and I were at a required work party. During the evening his direct boss made some sexual gestures behind my back with him and many other male employees standing there. Had my husband not stepped behind me he would have touched me. He let his direct boss know right then that he didn't appreciate him behaving that way and also told him again the next day. Both times he blew it off and laughed. He is thinking about going to the boss above him and would like to know a bit more of the legal aspect of this. So the question is, is it considered sexual harassment if it is an employees spouse?
