Civil Infraction

i was hit by a car that was speeding, and did not yeild at a red light, because I was turning left, i was issued the civil infraction for failure to yeild. A witness stated that the light was still yellow as she started crossing the intersection. She did not get a ticket. She stated to me that she did not see me because she wasn't paying attention. She never tried to stop. If I fight the ticket, do I have a chance to win. I have been driving for 15 years and have never had a ticket or an accident. Also, the collision shop stated that in order for her car to do the damage that was done, she had to have been driving at least 50-55mph. The speed limit was 40mph. I have pictures of the road to show there were no skid marks which indicates that she never tried to stop.

You definitely have a good chance of having it reduced to a no-point violation, or at least something with less points than failure to yield. I personally have gotten out of a traffic ticket for rear-ending someone. However, you should hire an attorney to handle the hearing and negotiations, as most prosecutors will not give good deals to those without an attorney (unfair, I know).

The best way to approach it is by NOT offering a bunch of excuses, but focusing on the fact that you have a clean record and would like to keep it that way to avoid a spike in your insurance, which will go up anyways due to the accident, whether or not you make a claim.
