are curbs at gas station suposed to be painted

when iw as pulling out of the gas station there was a 3 inch curb with a good drop on the other side but i couldnt see it because the asphalt was black and the curb was black and it had just rained so it was unseeable and when i pulled up it ripped my bumper off causing underlying damages

are curbs surrounding gas stations suposed to be painted red or yellow or something to be made seen

if so can i sue for the price of the damages

You would have to check the ordinance of the city where it happened. However, roadside curbs are likely considered an open and obvious condition and a consumer/customer is responsible for paying attention to all conditions of the road, even at night or in bad weather, and they are likely not responsible for any damages to your car. If the curb was defective, too high, or protruded into the driveway, then that is a different story. Your best bet is to go look at it daylight, talk to the manager, and see what happens. They will likely you offer nothing, and it is probably not worth your time or expense or pursuing a legal action.
