Passing A Stopped Vehicle When A Double Yellow Line Is Present

While waiting to turn South (from the East) on a two lane road, a car stopped in the Southbound lane and waved my son out. Looking North, then South he proceded and suddenly found a car traveling South in his path. It had passed the stopped car but had to cross over a double yellow line to pass. This was right at a place where the road was beginning to form a turning lane but clearly only two real lanes (North/South) at the place of the accident. The officer cited my son but only took the other person's story...not sure why my son wasn't asked to fully give his side. Other person conveniently failed to mention the stopped car that was passed and my son being quiet did not speak up. No injuries in the accident. Headed to court with pictures of the double yellow line but wonder what advice would be given here? Thank you.

You seem to mean well, but you should know that the judge will not let you represent your son or speak at all. He must conduct his own defense unless he has a lawyer.

It won't be much of a case if you asked for an informal hearing. It will then be your son's word against the officer's. Guess who will be the most credible!

There is another approach to this that avoids a hearing altogether and will actually have a chance of getting you the results you want.
