Legal Question in Traffic Law in Michigan

I received a traffic citation for a violation of the basic speed law, this is my first offense and I was going under 10 mph over the speed limit. The officer said that I would receive 2 points on my license. When I looked at the ticket issued it is all my father's information. The car is registered in his name, however, he was not the driver or even present. The ticket is a printed ticket nothing is handwritten. Will they dismiss the ticket?

They could, but they will likely amend the ticket to include your information. Either way, it is worth fighting, based on your clean record, in order to obtain a no point violation that will not show on your record (driver's abstract) or affect your insurance. The zero point violation of "limited access 0-5" DOES show on your driving record, it is just no points, so do not be fooled into thinking that is the best deal - it's not. You want impeding/blockading traffic or double parking as your ultimate guilty plea (assuming the ticket isn't dismissed, etc). The officer must have copied down the registration information instead of that from the driver's license when entering the ticket information. Contact the court and request a formal hearing. If you want to retain a lawyer to assist you, please contact me. My rates are low & very reasonable, especially for traffic citations.

Good luck.

Thank you.

Go to court and get this straightened out. If your dad's driving record is affected, it will not go well.
