Legal Question in Traffic Law in Michigan

Removing misdemeanor charge

I got a ticket for expired tags.I got my tags and paid the fine. Now I understand the state of MI considers ths a misdemeanor charge and it is on my record. The court clerk said ''don't worry, you don't get points and it's not on your driving record, just on file with the state. Can I do anything to get this removed? I worry it may affect future job applications, bonding, etc. I have nothing on my record, not even a traffic infraction. Help!

Re: Removing misdemeanor charge

Your best bet is to hire an attorney to file a motion to set aside the guilty plea and start all over again. If your record is as clean as you say, most prosecutors are willing to work out a deal that would eliminate a misdemeanor conviction for a first offense. I have done this many times for clients and have been successful each time--even those with past traffic offenses.

Re: Removing misdemeanor charge

There are ways to have the misdemeanor removed. However, the quickest way is to work with the city attorney or prosecutor who handles the jurisdiction in which you received your ticket. let me know if I can be of assistance. John C. Talpos (248) 743-6800 (http://www.Mich-Lawyer.com)

What we need to do is file a motion to set aside your plea. Then we need to have the matter set for a hearing. I believe you will not have a problem. You have a good record and most prosecutors will work with me on this. Please call my office and we can get started. Toll free @ (8 6 6) M I C H D U I
