Legal Question in Traffic Law in Michigan

restricted license - can it be reduced?

My daughter received a speeding ticket in March 2006 when she was 16 - 4 points. She received a 2nd ticket in August 2007 - 3 points. In January 2008, SOS gave her a restricted license through July 2008. I think this is excessive. She has had no accidents, is a great student, volunteer worker and overall good kid. Her restricted timeline exceeds her GDL timeline and for 40 days after graduation, she can drive only to-from work until July. Is it worth trying to reduce the this restriction to perhaps April, when her first ticket will be removed from her record??? We restricted her driving for 30 days following each ticket and I feel this additional restriction does not fit the infraction.

Re: restricted license - can it be reduced?

SOS has the exclusive jurisdiction on licenses now. The mistake that you and your daughter made were not fighting the tickets when received, even if they were deserved. The points could possibly have been reduced and then she might not be in this situation. Always consult an attorney before any legal matter.

A reduction is unlikely. Every action to modify a disposition of any kind must have a credible premise to be effective. Your post lacks this.

Parents are well advised to fight their children's first tickets and not wait to contest resultant licensing sanctions.

The first ticket is the most important because a spotless record is often a prosecutor's rationale for agreeing to subsequent plea bargains.

The cost for legal help on the first ticket is minor compared to unwanted fines, license penalties, and increased insurance rates.
