Legal Question in Traffic Law in Michigan

wrongful arrest

My son was pulled over for fishtailing as he was leaving school grounds. (the roads were bad from the winter storms that we have been having for the last week. He only had his license for 4 months and his first time driving on bad roads.) He was immediately arrested no questions asked and no warning or ticket. He wasn't read his rights (Miranda rights) Now he faces 6 points on his driving record. Higher insurance costs. Is there any advice you can give?

Thank you very much.

Re: wrongful arrest

Sounds like he was ticketed for reckless driving which means heavy fines and costs (~$2000) plus a loss of his license for 6 months. (93 days in jail is possible but not probable... but it is a misdemeanor) Reading of Miranda rights is not required.

Most criminal lawyers know how to get this charge reduced which will save you at least $1000;save his license; and lessen your insurance premium.

Even though you're his father, you are not allowed to represent him in court.
