Legal Question in Traffic Law in Michigan
Yellow Lights and fault durring an accident
If you are making a left hand turn, and someone doing 60-65 mph in a 50 mph zone hits you (coming from the opposite way you were turning from) while you are turning, who's fault is it? Keep in mind, you had already been in the middle of the intersection waiting, and they ran a yellow light while you were starting to turn and witnesses saw them speed up while aproaching the intersection to beat the red light. (What if the light had turned red durring the ordeal? Whose fault would it be then?

Re: Yellow Lights and fault durring an accident
you still have the duty to yield to oncoming traffic. they are supposed to stop at a yellow unless they are unable to, but a judge would likely determine that the person turning left was more at fault. if you are in michigan, it doesn't matter who is at fault, your insurance still covers it.
and if you received a ticket for the accident, you can still request a formal hearing and dispute it, and hopefully it can be knocked down to a no-point violation.
