Legal Question in Wills and Trusts in Michigan
Attorney as suc trustee u/a on Savings Bonds
I have savings bonds due to death of my mother with an attorney's name, then my mother's name with date of trust. The attorney has not been involved in the estate after her death nor is responding to my e-mails re the bonds. Can I cash the bonds w/o his signature, and if so, what form(s) do I use? If not, can I get him to resign and what form can I send him to resign? If needed, can I use an attorney in California to help or does it have to be an attorney from Michigan. The bonds were sent to me from the bank trust dept as part of her estate. Thank you.

Re: Attorney as suc trustee u/a on Savings Bonds
In a nutshell, if the attorney at issue is the trustee, and has not been removed, the attorney would be the one with legal title to make decisions on the savings bonds per se. However, if the attorney trustee is unresponsive and failing to perform his duties as trustee, you can have him effectively removed.
