Legal Question in Wills and Trusts in Michigan
I had an aunt who died (3/15) and her estate went through probate which I was named as one of her relatives.
the lawyer that handled the case sent me a letter sating the court approved (2/16) so the remaing monies can be distributed to all parties. So does this lawyer actually send the monies or the executor ? Also how long does it take +-
also long should this take ?

It is difficult to say a time frame as everyone does things a little differently, however, once all assets have been taken care of and the bills have been paid, it generally takes me 2 weeks to get the checks out assuming the 120 day claim period has expired. In my office, the personal representatives send me and my office sends the checks to send to the heirs, unless the personal representative has reason to send them directly. Also, just because you are a family member entitled to notice, it does not necessarily mean you are entitled to money from the estate. The will may dictate a different distribution, which will take priority over distribution to heirs under the law when there is no will. Thus, the answer to your question depends upon the status of the estate and the creditors' claim period. You may want to contact the lawyer's office that is handling the matter periodically to find out what the status is.
