Legal Question in Wills and Trusts in Michigan

I am a beneficiary of a life insurance policy. My mother wrote in her will that I am to use the money for her funeral. The personal representative has shown favortism to another beneficiary and allowed to her take all the non-saleable items out of the house without including me, the other beneficiary to half her estate. Am I required by law to pay for the funeral expenses from the life insurance policy, or will the expenses be taken from the estate? The life insurance carriers said that I, the beneficiary, may decide what I do with the money as I am the beneficiary.

You are the beneficiary and there are no strings attached to those funds. Her wishes do not have to honored and those are your funds. If the Personal Representative disagrees and tries to take it from your share, you should win that battle in Court. Visit kliszlaw.com to discuss further. Tim Klisz
