Legal Question in Wills and Trusts in Michigan

cd/401k

I am the trustee/beneficiary in my mothers trust. The Trust clearly states 150,000. to my brother upon her death. her CD/401k has 180,000 in it and he is listed as beneficiary for that account. If she dies will he get more than the 150,000?

As I understand the facts, he is the beneficiary of that item and as such will be the person that does receive the value of it based on what you detailed. A named beneficiary on an account does receive it exclusive of other writings. You may wish to consult an attorney to see if there is any alternate way to address this.
