Legal Question in Wills and Trusts in Michigan
Only child's necessity for probate
My mother died suddenly last week. I am the only child and am named on one account, which is overdrawn by $33.00. She has myself and my 4 chldren named on her cd which time is up in 02-05. She had a modular home, paid for worth $14,000. which she had signed over to me. Do I need to get a lawyer? She has no assets, other then her life insurance policy for her burial and this c.d. She also has several(5) credit cards which are maxed out and basically purchased resale items. She has not assets in her home as well as in accounts. I do not want to spend any unnecessary money for lawyers or court, as I''m not sure if I will recoupe it.

You don't need a lawyer. See if that CD had a death call on it to make it payable upon her death. Otherwise, cash it in when it is due. Bill Stern
