Legal Question in Wills and Trusts in Michigan

Choosing an Excutor/Excutrix

Must a Michigan resident have a Michigan resident for an executor/executrix? Can a Michigan resident have an Ohio resident as executor/executrix?

To Whom It May Concern:

This is in response to your recent email.

In Michigan, executors and executrixes are now called personal representatives. A Michigan resident can have a non-resident personal representative. However, the non-resident personal representative must have an agent who does reside in Michigan and is thus subject to the jurisdiction of the appropriate probate court.

Sincerely,

Charles L. Nichols
