Legal Question in Wills and Trusts in Michigan

Co-owners of US savings bonds does it go to probate

My sister and I have both our names listed on several US savings bonds. Our names are listed using the word ''or'' on the front of the bond. My sister recently passed away. She has a will stating that all assets be equally divided among my other brother and sister. My Brother is the executor of the estate and demands that I surrender these bonds back to the estate to take an invetory of assets. Do I have to Surrendor these bonds?

The bonds sound like non-probate assets that should not be the concern of the personal representative. Have you explained to the PR that the bond was titled in your name? For more info, please contact my office at (248)851-3171.

What was the reason for having you on the bond as co-owner? If you are the owner of the bond then it isn't part of the estate.
