Legal Question in Wills and Trusts in Michigan

Dad's ex-wife beneficary to life insurance, divorce papers say not entitled.

My dad recently passed away and we found he had life insurance. The problem is that he has been divorced since 1999 and in the divorce papers it is stated that ex-wife is entitled to no insurance ''hereto therein''. I take that to mean that since the divorce is final and it says that she is entitled to no insurance ''hereto therein'' that she is not able to claim it because that means from this day forward, even if she is named beneficiary. The origianl policy does not name her but some underwriter policy does. Can you help me?

If the Judgment of Divorce was entered after the date the policy was taken out then she would be entitl;ed to nothing and the insurance would go to his estatemot to the alternative beneficiary if one is listed. If he took the policy out after the divorce and named her then she would get it. Contact an attorney in the County that the estate will be probated if the insurance company wants to pay to the ex-spouse. Good Luck.

Hello, I have received a copy of your e-mail regarding your father's ex-wife. It should be clear that she is no longer the beneficiary of any life insurance policies on his life. Please contact me to discuss the details of this case, the options available to you, and fee ranges. John C. Talpos (http://www.Mich-Lawyer.com) (248) 743-6800
