Legal Question in Wills and Trusts in Michigan

Dependents Equal Share of Estate

My 5 children's grandmother died. She was preceeded in death by her husband and her son( father of my 5 children). She has 3 adult daughters who are attempting to sell her property and have stated they intend to divide money 3 ways only. I think my children should be entitled to their father's share. What can they do to protect their interest in their grandmother's estate?

Re: Dependents Equal Share of Estate

I really need slightly more information. In general, if the grandmother had no Will with the grandchildren named in it, then they will not be entitled to any money or share. Under the state's intestacy (dying without a Will) laws in Michigan, the grandchildren would not be entitled to anything because there are living children of the deceased person and they are entitled to inherit the estate. Due to the fact the children's father is dead means his share is lost and his heirs will not collect unless there is a Will naming them.
