Legal Question in Wills and Trusts in Michigan

Estate distribution: Per Stirpes or By Representation?

There is some question about what "by representation" means in my mother-in-law's estate. There is agreement on "per stirpes". What is the difference, and is there a difference according to area of the country? (I'm in MD and her estate and residence is MI)

Re: Estate distribution: Per Stirpes or By Representation?

You need to ck. on Mich. law, since it's a Mich. estate. YOur 2 choices are: a. Per stirpes, and b. Per capita. CK. with the Register of Wills in MIch. to see whether "by rep." means "a" or "b". I wish you well,, and good luck!! I'm a Md. attorney, in Bethesda.
