Legal Question in Wills and Trusts in Michigan
I am executor of my dads probate, he had no will, I hired a lawyer and due to 401k and pension etc, we estimated about $60,000 and I opened a checking account in mine as executor and his name, I paid bills and almost 40,000 in taxes due to a gambling problem and penalities for his early withdrawl of 401k, etc. Currently there is about $19,000 left and I am suppose to just cut a check to my deceased brothers child who is 6, and to myself by splitting the money in half, I have payed a lot of money to a lawyer for advice and probate, and now he told me to just split it in half, no questions asked, no documents required, etc? Do I really need to give half to my deceased brothers daughter?

There should be a conservator appointed for the 6 year old or at least a restricted account set up through the court before giving a minor that much money. Please contact me to discuss in more detail www.johntatone.com
