Legal Question in Wills and Trusts in Michigan

my father died without a will.

My father just past away of a heart

attack on the 23rd of March. My

step mom has never had any

children and I have two other

brothers. He owned a large

business and was very well off.

Everything was in his, or his and

her name. Plus he didn't have a

will. What are our rights?

Re: my father died without a will.

You have certain rights. Essentially she gets the first 100,000 plus 50%. You and your siblings get the rest of the estate. The marital home and other items that were in joint names applies to the first $100,000.00 she recieves. So depending upon what is left in his sole name will determine how much you will recieve. If you would like my help, please contact me.

I am very sorry for your loss. I agree entirely with attorney Tatone. The laws of intestacy certainly apply and the children of the deceased do certainly have rights. What county did dad live in? If in SE Michigan, contact me at www.kliszlaw.com to get started.
