Legal Question in Wills and Trusts in Michigan
My father gave me durable power of attorney in 2004. He was healthy and of sound mind, he was just preparing for the future. He and I also had a joint bank account , since 1998. My father's health started failing in 2007, he moved in with me...he died 2009. After his death I contacted various (4) Annuity company's to identify the beneficiaries.. I was the sole benficiaries on 3 and 2 other family members were on the 4th annuity. We sent in the necessary documentation and the fund were disbursed. My father had a policy from the company he retired from and the funds were disbursed equally amongst his children. My siblings are not satisfied with the results of the inheritance. I had never unpacked all of my father's belongings after he moved in with me, I recently located a Will. It stated that specific amounts of monies went to 2 children and the rest was to be shared equally. His bank account which we held jointly was used for the funeral expenses, a few doctor bills, I gave my sister $10,000.00 check and his girlfriend $5,000.00 check as he requested before his death. After his death I gave my brother a check for $5,000.00 and gave another brother $5,000.00 in cash (his preference). So, the balance of this account is at approximately $5,000.00.
I found an IRA account last week and closed the account and deposited the money into the joint account, I was going to add that to his income tax refund and divide the total amongst my brothers and sister. They are not satified and feel that they are entitled to some of monies from the accounts that I was the sole beneficiary. They are not really talking to me and I have heard rumors that they are contemplating taking me to court. I also just turned the Will and all documents pertaining to this matter tover to a lawyer. I just wanted a heads up on what to expect and does it appear that I have did anything wrong.
