Legal Question in Wills and Trusts in Michigan

Father's estate.

My father passed away in 2005. A probate case was opened, the house was deeded into my name, and I also received insurance money through probate (The insurance company would not pay out to my grandmother (the named beneficiary) after a divorce). The mortgage company was not notified at any point, the mortgage remains in my father's name. Am I personally liable for the mortgage, specifically can the mortgage company force the probate case open again and take legal action against me since I was the personal representative of the estate?

Re: Father's estate.

I guess there are some missing facts here. Did you continue to pay the mortgage? If so, they don't care. If not, they will simply foreclose on the house and take it back. Since they were a known creditor, you needed to put them on notice, so this may be a problem. To discuss further, visit www.kliszlaw.com to contact me. Tim Klisz
