Legal Question in Wills and Trusts in Michigan
Fiduciary rights terminated
I was appointed fiduciary over my daughters estate for a dog bite settlement. I failed to file the annual account because I was not familliar with this process and didnt know how important it was to do so. The court did not have my correct address and was sending letters to my old address and I did not know that they were attempting reach me. I finally realised the court was involved when I was contacted by phone by an attourney appointed by the court to recover the money. He had my rights suspended and permenantly removed as fiduciary. He is now in charge and charging rediculous fee's to maintain this account. Is there any way to have another person or family member appointed as fiduciary so this attourney doesnt drain her account?

Re: Fiduciary rights terminated
Yes. You can petition the court to have the attorney removed and have a family member appointed. You may do it yourself by preparing the petition yourself, however it would be in your best interest for you to have an attorney do this.
