Fraudulant Will

Can a person sign a will, when they are heavily medicated, and their mental facalties are diminished? My stepbrother made a will up and had my mother sign it a few days before her death when she was in a hospice, and under heavy medication, and slipping mentally. She wasn't recognizing family members and couldn't even remember what she had just eaten.

This is called undue influence. the will can be attacked, but you cannot sit on your rights.

When did she die?

Was the will filed with the clerk of the circuit court?

Was an estate opened?

This is the basic information I would need to evaluate the questions.
