Legal Question in Wills and Trusts in Michigan

Grandmas will

My grandmother has a terminal illness, and wont live long. My aunt was made power of attorney over her money 2 years ago, at which time she had over 200000 in the bank. Each grandchild in the will is supposed to get 5000. I know for a fact that my aunt spent the entire 200k on addition to her house, vacations, cars. She also got my grandma to sign the house over to her. Any legal recourse to get some of this money back from my aunt, or the house? My grandma definitely was not in the right state of mind, being senile.

Re: Grandmas will

Yes. As a beneficiary you have standing to sue your aunt, even while your grandmother is alive. The sooner you act the better. If you aunt looses everything, you may have difficulty collecting on a judgment even if your Aunt is found to be liable by the Court. If you would like my help, contact me at johntatone.com

it will be an uphill battle, but it smacks of both incompetency and undue influence. Please contact me at www.kliszlaw.com to discuss. Tim Klisz
